Terms of Service

These Terms are the agreement between you and Rent Ratchet ("we", "us") for using rentratchet.com and anything else we run under that name (together, "the site"). By creating an account, listing a tool or asking to borrow one, you agree to these Terms, to the Disclaimer and to the Privacy Policy. If you do not agree, please do not use the site.

What Rent Ratchet is

Rent Ratchet is a notice board for tools. Owners list tools they are willing to lend, people nearby ask to borrow them, and both sides rate each other afterwards. Prices are quoted in joke units, such as cases of virtual beer or head of virtual cattle, that are not money.

We provide the notice board and nothing else. We do not own, inspect, store, deliver or insure any tool. We are not a party to any rental. Every rental is an agreement directly between an owner and a renter.

Who can use it

• You must be at least 18 years old and able to enter a binding agreement where you live.
• You must give accurate information about yourself and keep it up to date.
• One person, one account. Keep your sign-in details to yourself; you are responsible for what happens under your account.
• We may refuse, suspend or close an account, or remove a listing, when we believe these Terms were broken or someone is being put at risk.

No money, no goods, no kidding

• The site is free to use. We do not charge listing fees, rental fees or commissions.
• No payment of any kind passes through the site. We do not process, hold or forward money, and we never ask for card or bank details.
• The units used for prices are virtual. They have no cash value and cannot be bought, sold, transferred, cashed out or redeemed. The full virtual currency notice is part of these Terms.
• Anything real that an owner and a renter choose to exchange between themselves is their own private arrangement, outside the site and at their own risk.

If you list a tool

• List only tools that you own or have the right to lend.
• Describe the tool honestly: its condition, what comes with it, and anything a careful person would want to know before using it.
• Do not list a tool that you know is unsafe, defective, recalled, stolen or illegal to lend.
• Follow the listing rules shown on the site, including any categories of tools that we do not accept.
• You decide whom to lend to. You may decline any request.

If you borrow a tool

• Use the tool only for what it is made for, safely, lawfully, and with the right protective equipment.
• Inspect it before you use it. If it does not look safe, do not use it.
• Do not lend it on, alter it, or let a minor use it.
• Bring it back on time, clean, and in the condition you received it, apart from ordinary wear.
• If you lose or damage it, that is between you and the owner to put right.

Rentals are between the two of you

Requests, acceptances, hand-over and return confirmations, condition photos and reminders on the site are tools to help owners and renters keep track of what they agreed. They are records made by users, and we do not verify them.

We do not settle disputes between users. We may review a rental that has been flagged and act on accounts or listings, but we do not decide who is right, award compensation or recover tools. If someone has committed a crime, contact the police.

Ratings and other content you post

• Ratings must be honest and based on a real rental you took part in. No fake, paid, swapped or retaliatory ratings.
• Do not post anything unlawful, threatening, harassing, hateful, sexually explicit, misleading or infringing, and do not post other people's private information.
• Photos you upload should show the tool, not people's faces, documents or house numbers.
• You keep ownership of what you post. You give us a non-exclusive, royalty-free, worldwide licence to store, display, resize and share it as part of running and promoting the site, for as long as it is on the site.
• We may remove content that breaks these Terms. We are not obliged to monitor content and we are not responsible for what users post.

Things you must not do

• Use the site for anything illegal, or to arrange the loan of anything other than tools and equipment.
• Pretend to be someone else, or open an account for someone else without their permission.
• Collect other users' details, contact them for anything unrelated to a rental, or send spam.
• Probe, overload, scrape or interfere with the site, or try to get around its limits.
• Use the site to sell, advertise or promote alcohol, livestock or anything else the joke units happen to be named after.

Safety, risk and liability

Tools can hurt people. The Disclaimer sets out in full what we are not responsible for: that you use the site and every tool at your own risk, that there is no warranty and no insurance, that we are not a party to any rental, and that you assume the risks of dangerous tools. It also contains your promise to indemnify us. The Disclaimer is part of these Terms. Please read it.

All of those limits apply to the maximum extent permitted by law. Nothing in these Terms removes a right or a remedy that the law says cannot be removed.

Leaving

You may stop using the site at any time and may ask us through the contact form to close your account. Closing an account does not undo rentals already agreed or ratings already published; the Privacy Policy explains what happens to your data.

We may change, pause or shut down the site, or any part of it, at any time. Virtual trophies have no value and no compensation is owed for them if that happens.

Changes to these Terms

Each version of these Terms is numbered and dated at the top of this page. When we change them we publish a new version, and you will be asked to accept it before you next list or borrow. If you do not accept the new version, you can no longer start new rentals.

Questions and disagreements with us

If you have a question or a complaint about the site, tell us through the contact form first and give us a fair chance to fix it.

General

If any part of these Terms is found to be invalid or unenforceable, that part is to be limited or removed to the smallest extent needed and the rest stays in force. Our not enforcing a term on one occasion is not a waiver of it. These Terms, the Disclaimer and the Privacy Policy are the whole agreement between you and us about the site.
